Terms of service

1.The parties
These Terms are an agreement between you and Moksh Sethi (sole proprietor, d/b/a Pop the Lead) (“Pop the Lead”, “we”, “us”). By accessing or using Pop the Lead (“the Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
2.Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
3.Acceptable use
You agree not to use the Service to send spam, collect data without consent, or violate any applicable law including GDPR, CCPA, CAN-SPAM, or TCPA. You are solely responsible for the content you display in popups and the data you collect through them.
4.Subscriptions and billing
Paid plans are billed monthly or yearly via Dodo Payments. Subscriptions auto-renew until canceled. Cancellations take effect at the end of the current billing period and can be made self-serve from the customer portal at any time. Prices are in U.S. dollars unless otherwise stated. Dodo Payments is the merchant of record, so applicable taxes are collected and remitted by Dodo on our behalf.
4a.Refunds
We offer a 14-day refund window from the date of first paid charge. Within that window, request a full refund by emailing popthelead@gmail.com or via the contact form. Beyond 14 days we do not provide pro-rated refunds for the remainder of a billing period; you may cancel at any time and retain access until the end of the current period.
5.Data
You own the data you collect. We process it on your behalf as described in our Privacy Policy. You can export or delete your data at any time from your account settings.
6.Service availability
We aim for 99.9% uptime but do not guarantee it. We may perform maintenance or release new versions that temporarily disrupt the Service.
7.Termination
We may suspend or terminate your account if you violate these terms. You may close your account at any time via the dashboard.
8.Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9.Limitation of liability
To the maximum extent permitted by law, in no event shall Pop the Lead be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100.
10.Indemnification
You agree to indemnify and hold Pop the Lead harmless from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right — including any privacy, data-protection, or intellectual-property right.
11.Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of Uttar Pradesh, India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction in those courts.
12.Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after the effective date constitutes acceptance of the updated Terms.
